investigation. but we start with anna kooiman and the government seizure of secret procedures. unprecedented violation of the freedom of the press. the justice department under fire as attorneys for the associated press say it secretly obtained records for 20 phone lines both work and personal. they scanned several bureaus the press gallery and house of representatives. more than 140 reporters work in the offices where the records were taken. >> they haven't told us what they were looking for or why we didn't get prior notice. this seems to be very broad and we don't really know what it's about. >> the white house saying it has no knowledge of the doj inquiry. jay carney said we have no knowledge of any attempts by the justice department to seek phone records of the ap. we are not involved with

decisions involved with criminal investigations. the justice department refuses to say why it fought the records. prosecutors said they are investigating who leaked details about a al qaeda plot during the one year anniversary of osama bin laden's death last year. the president is outraged over the intrusion. he says there can be no possible justification for such an over board collection of the telephone communications of the associated press and its reporters. lawmakers are also outraged. john boehner releasing a statement saying this, the first amendment is first for a reason. the obama administration is going after reporter's phone records they better have a damn good explanation. the associated press is asking for all phone records to be returned and copies be

destroyed. now to the irs scandal growing by the day. we have learned it wasn't just the tea party. other conservative groups wer t. now a hearing has been scheduled for friday on capitol hill so lawmakers may get some answers. doug luzader is live with more on that. good morning, doug. >> good morning. this is growing fast with the "washington post" saying despite their denials the specific targeting of conservative groups they say was known to high level officials here at washington even as it was underway. a combhat tive obama said the irs was playing politics targeting nonprofit groups the tea party patriots or self identified educational groups promoting the constitution. >> it is contrary to our traditions and people have to be held accountable and it's got to be fixed.

>> the irs admitted to the effort but attempted to blame it on low level employees in the agency the lawyers for tea party groups for evidence say they were targeted by officials since washington supporting the decisions of many tea party leaders. >> a couple of low level employees out of cincinnati, ohio who have this much influence. literally it was coast to coast. >> the agency is already in plenty of hot water for initially denying to congress that con sefb ti-- conservative ever faced this scrutiny. >> the irs have not targeted specific groups. >> we pride ourselves on being a nonpolitical nonpartisan organization. there is absolutely no targeting. this is the kind of back and forth that happens when they apply for 501 c 4 status.

lied about them. what about the death trap created called the benghazi consulate. what about the 7 and a half hours they were being attacked and nobody could come to their aid. where is the outrage there? >> they want to join house committee to investigate benghazi. they may call former secretary of state hillary clinton to testify then. >> thank you kelly. i know you will stay on top of that story. we are staying with the pop stories and taking a look at who is talking this morning. >> britt tum is looking at how the president is handling benghazi and the irs saying it seems as though president obama is operating out of two different play books. >> there are two methods for dealing with the crises that be set the obama administration. the president seems to be trying them both one is take charge mode in which the leader acknowledges it is wrong says it's unacceptable pledges to get to the bottom of it make it public and set it right.

this is where the president seemed to be going regarding the irs conservative groups. the other is duck and cover in which they claim the matter is over blown and tries to blame somebody else. this is where the president has gone from the start and where he went again today. we learned last week the cia talking points on benghazi went through 11 rewrites at the behest of the state department and white house which referred to them from true to false by stripping out all references to tearrism. nothing new here mr. obama said adding the dubious claim saying he was involved in terrorism from the start. if that's true why did he allow susan rice to talk about the bogus points days later and add the bogus claim it all stemd from internet video. it may be late in the game for mr. obama to switch to take charge mode on benghazi but duck and cover sure isn't working either. >> bill o'reilly will have more

copies be returned. the irs scandal might be growing even larger now with new evidence it might have gone well beyond the so-called employees. we are going live this morning with more. the question all along has been how high up does this really go? irs officials here in washington not only knew about the specific targeting the conservative groups, they may have played an active role in it according to the "washington post" this morning. the irs already admitted to targeting specific groups for extra scrutiny in their names referenced the tea party, patriots, the constitution or other trigger words that indicated that they were part of conservative causes. but the agency blamed it on low level employees in cincinnati the idea that high level officials may have been involved would come as no surprise to tea party leaders.

following the events of the final 8th season which aired back in 2010. >> thank you ainsley. angelina jolie with shocking news she had a double mastectomy after discovering she had 87 percent chance of developing breast cancer. with more insight is dr. mark seigel. thank you for joining us this morning. >> how are you? >> i am doing good. angelina jolie is raising awareness for women to be conscious of their health. tell us about the testing she under went and this vrca 1 gene this genetic mutation. >> by the way heather you are right. it is so important she is coming out like this and setting a public example a young boy tifl actress that is telling people let's put our health first. the brca gene it stands for the breast cancer gene. it prevents cells from growing wildly. so what happens is if you have a

mutation in this gene or something goes wrong with it, then it can grow very quickly and you can get breast cancer. it's not the gene itself it's that the gene has a problem with it. >> a mutation. >> one in 300 to 500 have it. shouldn't i get checked for it? it is very rare very expensive to test. you should only have the test if you have a family history of breast cancer or there may be a likelihood of it. her mother as you know died of ovarian cancer and was tested and found out this gene which meant she had a 50 percent chance of getting it. she has been very medically correct in this. >> the test is a simple blood test. you talked about the expense of it. how expensive can it be? >> it canni be up to 3,000 dollars. one of the things she is tieing to do is get the cost down. insurance doesn't cover this. a lot of the women who need this test couldn't get it.

a simple blood test you can get the answer very, very quickly. generally it increases your lifetime risk of breast cancer to about 60 percent. that's about five times greater than what most women have. the risk in the general population is 12 percent. women already need to be thinking about their risks of breast cancer but this makes it five times. the personal decision what you are going to do with the information. >> she said she had 87 percent of breast cancer, 50 percent risk of ovarian cancer before having this procedure done. >> i want to explain that. it has something to do with her personal situation. it's not all statistics. on top of her having the gene you have to take into account her mother already had cancer and you figure it out on that basis. i don't want women out there to say what about me. what about me? we are talking about one in three. -- the chances are low women have this gene. >> thank you so much dr. ceiling.
